    T.D.I.U. Percentage a myth.

    For those not familer with TDIU i am going to give a brief explaination in hope this will help some people.
    T.D.I.U. is a 2 part Reg....Part A..Part B...
    Part A. says your suppose to have 2 disabilities totalling 70%,...plus a few more words but that is the bottom line....Now that is what the Va will tell you...Plus some other Orgs.
    They are always failing to tell VETS part B....If your unable to secure and maintain employment due to a service connected disability you are entitled to T.D.I.U...( Total Disability based on Individual Unemployability )..In other words the VA should rate even one disability at the rate and grant you TDIU paid at the 100% rate. The VA is suppose to take each Vet into concideration but rarely does. Don't be fooled.
    Now if you have been denied at the Regional Office and have been to the VBA and the VA is sitting on your claim. (18 ) months or longer, file a Writ of Mandamus via CoVa. Court of Vet Appeals, make it short and sweet, in my own case i kept it to two pages...I simply asked the Judge to grant my claim or order the VA to process the claim in a timely fashion, this got the Va off there rear and they had the claim done in 30 days with a 100% rating, It cost a 50.00 dollar filing fee but that can be waived...
    Any way, when that Federal Judge told them to work the claim and he gave them 21 days they came back and asked for a 2 week extension and the Judge granted it. The day before the extension expired the paper work came in the mail notifying me of the rating.
    Some times it takes this.

    Thanks for the info.I may soon be going back to the VA,I havent been in years but each winter Im losing more use of my hand due to an injury that occured while in the jungle(non -combat).I may need some advice.

    Hi Doc.
    Do you currently have any rating at all on your hand? If any injury prevents a person from securing/maintaining. employement they can get TDIU and it does not have to be combat related, service connection is all that is required.
    Get your ducks lined up before you file and hopefully you can get rated with out having to appeal and having it tied up for a few years.
    You have to think of the Va as a Merry go round..Meaning Budget, if ratings were granted on all that filed they would be way over every year, so as some die off others are added on, of course they will denie such occurs but it does, it has to.
